The short version
- Your photos stay yours. We only store and show them so the album works. We never sell them, advertise with them, or use them to train AI.
- Everything starts private. You choose who sees each album or photo. Admins can see everything, so they can keep the album safe.
- Only post what you have the right to share, and respect the people in your photos, especially children.
- It's a personal site. Each member gets free space; more can be arranged with the team for a one-time fee. Keep your own copies of anything important.
The full terms below are what count. This summary is just to help you find your way.
01About these terms
Photo Share (“the site”, “we”, “us”) is a private photo album run by Mohan Karki as a personal, non-commercial project for family and friends. These Terms of Service are an agreement between you and the site owner about how you may use it.
You accept these terms when you tick “I agree” while creating an account, or when you sign in or otherwise use the site. If you don't agree, please don't create an account or use the site. Our Privacy Policy explains what information we keep and why, and is part of these terms.
A personal site. Photo Share is run by one person for family and friends. It isn’t connected to, run by or endorsed by any employer, business or organization.
02Words we use
- Owner: Mohan Karki, who runs the site and is responsible for it.
- Member: anyone with an approved account.
- Admin: a member the owner has trusted to run the site. Admins see all content and manage members. The owner is an admin.
- Moderator: a member who can approve, decline and turn off regular member accounts, but does not see other people's private photos.
- Your content: photos, videos and documents you upload, plus the names, album titles and messages you add.
- Share: letting someone other than you see an album or photo: every member, chosen members, or whoever opens an invite link.
03Who can join, and your account
- Confirmation and approval. Anyone can ask for an account. You must confirm your email address, and your account must be approved before it can see a single photo: by an admin or moderator, or automatically when the admins have turned that on. Admins and moderators may decline, turn off or remove any account at their discretion.
- Age. You must be at least 13 years old. If you're under 18, you need a parent's or guardian's permission.
- Be yourself. Use your real name, give an email address you control, and keep it up to date. One account per person, and don't pretend to be someone else.
- Keep your account safe. Use a strong password you don't use elsewhere, and don't share your account. Tell the owner straight away if you think someone else has used it. You're responsible for what happens under your account.
- Sign-in sessions. For your privacy, the site may sign you out after a period without activity, or when you close your browser, depending on the settings the admins choose.
04Your photos stay yours
You keep all the rights you have in your content, including copyright in your photos. Uploading a photo doesn't transfer ownership to the owner or to anyone else.
To run the site, you give the owner a limited permission to store, copy, resize and display your content, and to make small preview images of it, only so that you, the people you share it with, and the admins can see and download it. This permission:
- is free, non-exclusive, and can't be passed on except to the service providers that run the site for us (see section 11);
- does not allow selling your content, using it in advertising, making it public, or using it to train artificial intelligence;
- ends when you or an admin delete the content, except for copies held briefly in our providers' backups, and copies other people have already downloaded (see section 05).
You confirm that you have the right to upload each photo, and the consent of the people in it where that's needed (see section 06).
06Content rules
This is a place for family and friends to share memories. To keep it that way, you agree not to upload, share or do any of the following:
Respect the people in your photos
- Photos of people taken in private settings (for example at home, in changing rooms or bathrooms), or that they'd reasonably expect not to be shared, without their permission.
- Photos of children unless you are their parent or guardian or have that person's permission. Keep photos of children in albums you share only with people you trust.
- Content that harasses, bullies, threatens, demeans or embarrasses someone, or that reveals other people's private information, such as ID cards, documents, addresses or phone numbers.
Keep it lawful and appropriate
- Nudity, sexual content or graphic violence.
- Any sexual content involving a minor. It will be removed, the account closed, and it will be reported to the National Center for Missing & Exploited Children and law enforcement.
- Content that is illegal, hateful, or that promotes violence or self-harm.
- Content you don't have the rights to, such as other people's photography, artwork or copyrighted material.
- Malware, or files disguised as something they're not.
Keep confidential things out
- Anything confidential you aren't allowed to share, from work or elsewhere: documents, screens, ID cards, access badges or codes. When in doubt, leave it out.
Private messages
- The same rules apply to messages: no harassment, threats, spam, or sharing other people's private information.
- Pressing Send gives you 5 seconds to Undo. After that, you can unsend your own message for both people within 24 hours, but the other person may already have read it.
- Messages are deleted automatically after the time the admins set, and admins may delete old messages to free space. Keep your own copy of anything important.
- If someone sends you something that breaks these rules, tell the owner. Only you can show it to them, since admins can't open your messages.
Don't misuse the site
- Trying to get around the access rules, see content not shared with you, or break, overload or probe the site's security.
- Using bots or scripts to copy content in bulk, uploading malware, or sending spam, ads or other commercial messages through the site or its contact form.
- Sharing your account, or helping someone who has been removed get back in.
07What admins can see and do
So you can make informed choices, here's exactly how the site is run:
- Admins can see every photo and album, including private ones, along with every member's name, email address and account status, and messages sent through the contact page. Admins use this access only to run the site, help members, and deal with problems or reports.
- Moderators can see members' names, email addresses and account status so they can approve accounts. They do not see other people's private photos.
- Private messages are only for the two people in a conversation. Admins and moderators can't read them on the site. Admins can see how many there are, set how long they're kept, and delete old ones to free space.
- Admins may remove any content, or turn off or remove any account, that breaks these terms or puts other members at risk. We'll try to explain why, unless doing so would be unsafe or unlawful.
- Admins can't see your password. Passwords are handled by our sign-in provider and stored only in scrambled (hashed) form.
08Copyright complaints
If you believe something on the site infringes your copyright, email the owner at with:
- your name and contact details;
- the work you own, and which photo or album you believe infringes it (an album link helps);
- a statement that you believe in good faith the use isn't authorized, and that your notice is accurate and you are the owner, or are allowed to act for the owner.
We'll remove or restrict the content while we look into it, and let the uploader know. If the uploader believes it was removed by mistake, they can reply with their explanation. Accounts that repeatedly infringe will be removed.
09Leaving, or being removed
- You can leave at any time. Download anything you want to keep, then delete your account under My account (or ask the owner to do it). You can also delete your own photos and albums whenever you like.
- When you ask us to delete your account, we'll delete it, along with your photos and albums unless you ask us to keep them for the people you shared them with. Photos other people added to your albums belong to them and are kept.
- Admins may turn off or remove an account that breaks these terms, is inactive for a long time, or when the site is closing. When an account is removed, its invite links stop working.
- Sections 04 (for content that remains), 08, 12, 13 and 15 continue to apply after your account ends.
10A personal service, and storage space
- The site is run on a best-effort basis by one person. It runs on service plans with storage limits, and the database may pause after a period with no visitors. It may be unavailable at times.
- Free space. Each member gets free storage space set by the admins (currently shown in My account). Photos, videos and documents you add all count toward it. The whole site also has a total capacity; when it's full, nobody can add files until space is freed or added.
- Extra space. You can ask the Photo Share team for more space. It's a one-time payment per GB at the price shown on the site (when a file doesn't fit, and in My account). Payment is arranged directly with the team; once they've received it, they add the space to your account. The extra space stays with your account while the site runs and ends if your account is deleted. Ask the team about refunds before you pay.
- Admins may change the free space, the site's capacity or the price for future purchases. Space you've already paid for isn't taken away by such a change.
- Keep your own copies of photos and files that matter to you. The site is a way to share them, not a backup, and everything on it may be removed automatically.
- Features may change, and the site may be closed. If it closes, the owner will try to give members at least 30 days' notice so you can download your photos.
11Services we rely on
The site's pages are delivered by Cloudflare Pages from code kept on GitHub. Accounts and the database are provided by Supabase, in the United States, and photo files are stored by Cloudflare R2. These companies process information for us as described in the Privacy Policy, and their own terms and privacy policies apply to how they run their services. We aren't responsible for outages or changes on their side. The GitHub, Supabase and Cloudflare names and logos are trademarks of their owners, shown only to say which services the site runs on.
12No guarantees
The site is provided “as is” and “as available”. To the extent the law allows, the owner makes no promises that it will always be available, error-free or secure, or that content will never be lost, and disclaims all implied warranties, including fitness for a particular purpose. The owner isn't responsible for content that members upload, though we'll act on reports as described above.
13Limits on liability
Because the site is a free personal service, and to the fullest extent the law allows, the owner and admins won't be liable for indirect, incidental or consequential losses, or for lost data or photos, arising from your use of the site. Nothing in these terms limits liability that can't be limited by law, such as for fraud or deliberate wrongdoing.
You're responsible for the content you upload and how you use the site. If someone makes a claim against the owner because of content you uploaded in breach of these terms, you agree to help resolve it and cover reasonable costs it causes.
14Changes to these terms
We may update these terms as the site changes. Each version is dated at the top of this page. If a change is significant, we'll ask you to review and accept the new version the next time you sign in. If you don't accept it, you can ask us to close your account.
15Disagreements and governing law
If something goes wrong, please contact the owner first. Most problems can be sorted out quickly and informally. These terms are governed by the laws of the Commonwealth of Massachusetts, United States, except where the law of the place you live says otherwise. If any part of these terms can't be enforced, the rest still applies.
16Contact
Questions about these terms, reports about content, or account requests: email , or use the contact page.
